LUPINE VILLAGE AT GRAND LAKE: SHORT TERM RENTAL AGREEMENT V3

This Short-Term Rental Agreement (the “Agreement”) is made by and between Lupine Village Properties LLC (“Lupine Village”) and Guest named on the reservation as of the date the booking is confirmed. By completing this booking, for good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:

Rental Party:

  • Guest is at least 21 years of age and will be present during the entire rental period.
  • Guest is fully responsible for all members of their party.
  • Rental party shall consist of Guest and the number of persons indicated by Guest at time of booking.
  • Only those persons included in the Rental Party may occupy the property overnight.

Occupancy:

  • Standard cabin occupancy is one or two persons.
  • An extra person fee is added to the nightly rate for guests three and four.
  • The maximum number of overnight guests is limited to four persons in any cabin, without exception.

Rental Rules: Guest and all members of the rental party agree to abide by the following rules while on premises:

  • NO SMOKING OF ANY KIND inside any of the cabins. Guests may smoke outside with courtesy distance from other guests and proper disposal of cigarette butts, provided there are no fire restrictions in place.
  • Guest will not damage or misuse the property, cabin or contents, or allow their guests to do so.
  • Quiet Hours in the Courtyard are from 11pm-9am. After 11pm, Guest shall move indoors or to another location.
  • Guest will not act in a loud, boisterous, unruly or thoughtless manner or disturb the rights of neighbors to peace and quiet or allow their guests to do so.
  • Gatherings on the property are limited to registered guests staying at Lupine Village.
  • Guest will use the cabin only as a private accommodation and will not engage in any activity or allow any condition that is illegal, dangerous, or which would cause a cancellation, restriction, or increase in Lupine Village’s insurance premium, or allow their guests to do so.

Cleaning/Damages: Lupine Village will provide an exceptionally clean cabin upon check-in, and Guest agrees to leave cabin in good condition upon check-out. If the premises appear dirty or damaged upon arrival, Guest shall inform Lupine Village immediately. Each cabin is fully furnished and includes fresh linens, towels and toiletries upon arrival. No daily housekeeping service is provided, but we’re happy to replenish items upon request.

Lupine Village does not charge a fee for standard cleaning, so Guest agrees to tidy up before departure, including:

  • Gather used towels in provided bag
  • Wash dishes, wipe soiled surfaces (dish soap, scrubber, drying rack & Lysol wipes are provided)
  • Take out the garbage/recycling
  • Vacuum if there is significant visible debris or food on floors/furniture.

If cabin requires extra cleaning after guest departure, Guest will be charged a rate of $100/hour ($50 minimum charge) after check-out. Examples of non-standard/extra cleaning include:

  • More than one of the above tasks not completed
  • Stain or pet fur removal from furniture, carpet or linens
  • Excessive dirt, food, dirty dishes or other mess requiring extra cleaning time
  • Any other cost incurred by Lupine Village due to Guest’s stay.
  • Guest will inform Lupine Village immediately if there are any issues with the cabin; especially with any water leakage or other maintenance issue that may cause damage to the property if not remedied immediately.
  • Guest shall pay for any repairs or replacement, all loss or damage to the cabin and its contents whenever such damage or loss is beyond normal wear and tear

Payment:

  • 9.2% sales and 1.8% county occupancy taxes (11% total) are collected with every reservation.
  • Reservation is confirmed with payment of 50% of the booking total by Credit Card.
  • The remaining 50% is due 7 days before scheduled arrival. A link to complete payment will be sent to guest E-mail 10 days before check-in.
  • Bookings fewer than 7 days from reservation date will require 100% upfront payment to confirm.

Cancellations/Refunds:

  • Guest may cancel booking up to 10 days before scheduled arrival and receive a full refund of all payments, or reschedule stay with full credit toward a new reservation within 12 months
  • Guest cancellations fewer than 10 days from scheduled arrival but at least 48 hours before check-in are eligible for refund with the first night (including taxes) deducted, or full credit toward future booking within 12 months
  • Guest cancellations less than 48 hours from scheduled arrival but before 4pm on check-in day are eligible for refund with the first two nights (including taxes) deducted, or full credit toward future booking within 12 months
  • Cancellations received after 4pm on day of scheduled arrival are not eligible for refund or credit.

Video Surveillance: For the safety and security of Lupine Village guests, the canteen, courtyard, parking and other shared outdoor areas may be under video surveillance. There are no cameras inside or pointed into private cabins.

Destroyed or Unlivable Cabin: If the cabin is unfit to stay in due to any cause, Lupine Village Management may terminate this rental agreement immediately with no further liability to Guest. If the destruction or damage was not Guest’s fault and Lupine Village terminates this rental agreement, unused payments will be refunded to Guest.

Governmental Restrictions: If any government unit places a restriction on the ability to rent this property, Management may terminate this rental agreement immediately with no further liability to Guest. In this event any unused payments will be refunded to Guest.

Accidents: Lupine Village is not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. Lupine Village is not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.

Equipment waiver: Guest acknowledges that any equipment available for guest use is used as-is, and that Lupine Village is not responsible for any accidents or injuries arising from use of equipment. Renters assume full responsibility for use of snowshoes, walking sticks, fishing poles, and any other equipment available to guests. Owners assume no responsibility for injury or death as a result of use. Guests acknowledge that they have a duty to inspect equipment prior to use to assure that it is in a safe and proper condition for use.

No Liability/Indemnification/Hold Harmless: Lupine Village does not assume liability for the loss, theft, damage or injury (or death) to persons or their personal property. Guests agree to indemnify and hold the Lupine Village harmless for any liabilities, theft, damage, cost or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection with Guests’ use and occupancy of the rental property, including but not limited to claims for personal injury or property damage/loss, in accordance with the laws of the State of Colorado.

Check-Out: Guest will vacate the cabin by 11am on the date this rental agreement ends, unless a late checkout has been requested and is available. If Guest refuses to vacate after this rental agreement ends, Guest will be liable to Lupine Village for any resulting losses, including rent and court costs.
